PROVISION

on the Ministry of Statistics and Analysis of the Republic of Belarus

1. The Ministry of Statistics and Analysis of the Republic of Belarus (Minstat) is a republican body of state administration; it pursues the state policy in the field of state statistics, administers state statistics in the Republic of Belarus, and coordinates activities in this sphere.

2. In its activities, Minstat is governed by the Constitution of the Republic of Belarus, the Law of the Republic of Belarus of 28 November 2004 “On State Statistics” (National Register of Legal Acts of the Republic of Belarus, 2004, ¹192, 2/1094), other acts of legislation, and the present Provision.

3. The Minstat and territorial bodies of state statistics form a part of the system of the bodies of state statistics.

Regional statistical offices and the Minsk City Statistical Office are referred to territorial bodies of state statistics.

The structure of regional statistical offices and the Minsk City Statistical Office comprises statistical offices in districts and towns (districts of Minsk City).

The system of the Minstat includes:

state institution “Research Institute of Statistics of the Ministry of Statistics and Analysis of the Republic of Belarus”;

information and technological unitary enterprise of the Ministry of Statistics and Analysis of the Republic of Belarus “Main Computer Centre”;

republican unitary enterprise “Computer Centre of the Brest Regional Statistical Office”;

republican unitary enterprise “Computer Centre of the Vitebsk Regional Statistical Office”;

republican unitary enterprise “Computer Centre of the Gomel Regional Statistical Office”;

republican unitary enterprise “Computer Centre of the Grodno Regional Statistical Office”;

republican unitary enterprise “Computer Centre of the Minsk Regional Statistical Office”;

republican unitary enterprise “Computer Centre of the Mogilev Regional Statistical Office”.

The Minstat, aiming at the fulfillment of the incumbent functions, can set up, re-organise, and dissolve organisations in the manner prescribed by the legislation.

4. The main tasks of the Minstat shall be as follows:

4.1. elaboration of the scientifically grounded statistical methodology and its improvement in compliance with the national and international standards in the field of statistics;

4.2. collection, processing, compiling, accumulation, storage and protection of statistical data (information) on the basis of statistical methodology;

4.3. mandatory submission on a free basis of summary statistical data (information) to the Administration of the President of the Republic of Belarus, National Assembly of the Republic of Belarus, Council of Ministers of the Republic of Belarus, republican bodies of state administration and other state organisations subordinate to the Council of Ministers of the Republic of Belarus, according to the lists approved by the Minister of Statistics and Analysis;

4.4. dissemination of summary statistical data (information) among other users.

5. The Minstat shall have the right to:

5.1. engage respondents into state statistical observations in the manner established by the Minstat;

5.2. receive from respondents on a free basis, in the manner established by the Minstat, primary statistical data in the volume and within the deadlines indicated in the state statistical observation forms;

5.3. receive from state bodies (organisations) the information required to organise and conduct state statistical observations and compile summary statistical data (information);

5.4. receive, in the prescribed manner, on a free basis, from state bodies (organisations) that keep state statistics on the organisations subordinate (accountable) to them, as well as on issues that fall under their competence, summary statistical data (information) obtained from non-centralised state statistical observations conducted;

5.5. check the reliability of primary statistical data by comparing them with the data in primary records; visit with this purpose production, service and other buildings and premises of legal entities, their separate subdivisions, as well as buildings and premises where individual entrepreneurs carry out their entrepreneurial activities;

5.6. receive from respondents required clarifications and materials regarding the distortions disclosed in state statistical reporting;

5.7. provide respondents with mandatory instructions on the elimination of distortions disclosed in the data of state statistical observations and make corresponding changes in summary statistical data (information);

5.8. draw up protocols on administrative violations within the bounds of its competence in the manner prescribed by legislative acts;

5.9. take mandatory for respondents decisions within the bounds of its competence;

5.10. engage in the prescribed manner research and other organisations, scientists and professionals for the elaboration of selected issues of state statistics;

5.11. receive in the manner prescribed by the legislation the information from the Single State Register of Legal Entities and Individual Entrepreneurs and other registers (catalogues) that are maintained by the republican bodies of state administration and other state organisations subordinate to the Council of Ministers of the Republic of Belarus;

5.12. provide clarifications, including those in the mass media, on the organisation and maintenance of state statistics in the republic;

5.13. carry out co-operation with statistical agencies of other countries and international organisations in the field of statistics;

5.14. disseminate on a payment basis summary statistical data (information), unless otherwise provided for by the legislation, and provide other information services in the manner prescribed by the legislation;

5.15. compile and keep statistical register;

5.16. hold tenders in the manner prescribed by the legislation and conclude state contracts for the delivery of goods, execution of works and provision of services for the needs of the Minstat, as well as for carrying out research works in the field of state statistics for state needs;

5.17. enjoy other rights provided for by other acts of the legislation.

6. The Minstat, in accordance with the incumbent tasks, shall:

6.1. elaborate and improve statistical methodology in accordance with the national and international standards in the field of statistics;

6.2. organise and conduct state statistical observations;

6.3. provide methodological guidance on the organisation and performance of centralised state statistical observations;

6.4. approve state statistical observation forms and instructions for completing thereof;

6.5. process primary statistical data using modern information technologies;

6.6. provide users with summary statistical data (information) in the manner prescribed by the legislation;

6.7. provide in the mass media required clarifications on the use of the methodology of statistical data compilation and required information on the general changes in state statistics;

6.8. exchange summary statistical data (information) with statistical agencies of other countries, as well as provide international organisations with summary statistical data (information) in accordance with the international treaties, to which the Republic of Belarus is a party;

6.9. ensure the preparation of summary statistical information on the main social and economic indicators of the Republic of Belarus in comparison with similar indicators of other states;

6.10. provide respondents on a free basis with blank forms of centralised state statistical observations and instructions for completing thereof in the quantity required for their submission to all addresses indicated in the forms;

6.11. ensure accumulation, storage and protection of statistical data (information);

6.12. ensure confidentiality of primary statistical data and their use for the purposes if state statistics;

6.13. ensure security of state secrets, as well as commercial, personal and other secrets protected by the legislation;

6.14. keep in the prescribed manner national classifications of technical and economic and social information to be used in statistics;

6.15. exercise control over the activities of territorial bodies of state statistics and subordinate organisations;

6.16. organise training, retraining, and advanced professional training of employees of the bodies of state statistics;

6.17. ensure control over the effective use and security of state property in the bodies of state statistics and subordinate organisations;

6.18. ensure interaction of state statistical information system with automatic information systems of the republican bodies of state administration and other state organisations subordinate to the Council of Ministers of the Republic of Belarus;

6.19. ensure mobilisation preparation of the Minstat as well as control over and co-ordination of the activities of territorial bodies of state statistics and subordinate organisations with regard to their mobilisation preparation;

6.20. ensure that the Book of Notes and Proposals is kept, and appeals of citizens are considered in accordance with the legislation;

6.21. perform other duties in accordance with the legislation.

7. Employees of the bodies of state statistics shall bear responsibility in accordance with the legislation for the violations committed while carrying out state statistical activities.

8. The head of the Minstat shall be the Minister who shall be appointed and dismissed by the President of the Republic of Belarus.

9. The Minister shall have deputies who shall be appointed and dismissed in accordance with the legislation. The number of Deputy Ministers shall be determined by the President of the Republic of Belarus on the presentation of the Council of Ministers of the Republic of Belarus.

10. The Minister shall:

10.1. administer activities of the Minstat and bear personal responsibility for the exercise of powers vested in the Minstat;

10.2. make proposals to the Council of Ministers of the Republic of Belarus on the appointment and dismissal of Deputy Ministers;

10.3. allocate responsibilities among Deputy Ministers, heads of structural subdivisions of the Minstat apparatus;

10.4. submit to the Council of Ministers of the Republic of Belarus draft acts of legislation to be considered, as well as proposals on the consideration of issues falling under the competence of the Council of Ministers of the Republic of Belarus;

10.5. approve the structure and personnel arrangements of the Minstat apparatus, as well as the number of employees of the territorial bodies of state statistics to comply with the prescribed personnel number and labour compensation fund;

10.6. approve provisions on the structural subdivisions of the Minstat apparatus and territorial bodies of state statistics, and by-laws of the subordinate organisations;

10.7. pursue state personnel policy aimed at staffing the bodies of state statistics and organisations subordinate to the Minstat with highly qualified employees, administer the system of retraining and advanced professional training of specialists, form administrative reserve;

10.8. conclude contracts with the heads of territorial bodies of state statistics and organisations subordinate to the Minstat, as well as exercise control over the performance of terms and conditions of these contracts;

10.9. hire and dismiss employees of the Minstat apparatus in accordance with the legislation and terms and conditions of employment agreements (contracts);

10.10. submit proposals to the Ministry of Finance on the formation of draft republican budget with regard to the financial provision of the activities of the Minstat and its territorial bodies;

10.11. act without proxy on behalf of the Minstat, represent its interests in compliance with the present Provision, administer funds and property of the Minstat in the manner prescribed by the legislation, open accounts in banks;

10.12. ensure protection of state secrets in the Minstat apparatus;

10.13 administer funds in the manner prescribed by the legislation;

10.14. submit in the prescribed manner recommendations for the conferral of state awards and titles of honour to employees of the Minstat apparatus, territorial bodies of state statistics and subordinate organisations, apply incentive schemes to these employees;

10.15. enjoy in compliance with the legislation right of possession, use and management of state-owned property pertaining to the republican property;

10.16. designate in the prescribed manner representatives of the State in the management bodies of joint-stock companies and other legal entities, the stocks (shares) of which belong to the Republic of Belarus and are transferred to the Minstat for management;

10.17. take part in the meetings of the Council of Ministers of the Republic of Belarus;

10.18. conclude contracts within the bounds of its competence in the manner prescribed by the legislation;

10.19. exercise other powers in accordance with the legislation.

11. The Minstat, within the bounds of its competence, shall pass (issue) normative legal acts. The Minstat may, as it deems necessary, pass (issue) normative legal acts jointly with other republican bodies of state administration.

12. The collegium shall be set up in the Minstat, that shall be composed of the Minister (Chair of the Collegium), Deputy Ministers Ex Officio, heads of the structural subdivisions of the ministry apparatus, as well as the heads of the territorial bodies of state statistics and organisations subordinate to the Minstat.

The number of members and composition of the Collegium shall be approved by the Council of Ministers of the Republic of Belarus upon presentation of the Minister.

The decisions of the Collegium shall be documented by the regulations of the Minstat and the orders of the Minister.

In case any divergence in opinion arise between the Minister and members of the Minstat Collegium while discussing issues and taking decisions, the Minister shall carry his decision into effect and inform about it the Council of Ministers of the Republic of Belarus. The Collegium members may make their opinion known to the Council of Ministers of the Republic of Belarus.

13. The activities of the bodies of state statistics shall be funded from the republican budget and other sources not prohibited by the legislation.

14. The Minstat shall be a legal entity, have own current (settlement) and other bank accounts and the seal with the State Emblem of the Republic of Belarus and its name thereon.
