STATUTE

OF THE NATIONAL STATISTICAL COMMITTEE

OF THE REPUBLIC OF BELARUS

 

Section 1

GENERAL PROVISIONS

 

1. The National Statistical Committee of the Republic of Belarus (hereinafter referred to as Belstat) is a republican government authority in the field of state statistics pursuing the state policy in the field of state statistics, and excercising regulation and administration, as well as coordination of activities of other government agencies and other organizations in this field.

2. In its activity, Belstat is governed by the Constitution of the Republic of Belarus, laws of the Republic of Belarus, acts of the President of the Republic of Belarus including the present Statute, other normative legal acts, and is independent in carrying out state statistical activities.

3. Belstat is a government agency holding the rights of a legal person directly subordinate to the President of the Republic of Belarus, has a current (settlement) account and other accounts in banks, a stamp and letterhead forms holding the representation of the National Emblem of the Republic of Belarus and its name.

4. The system of Belstat comprises the central office of Belstat, territorial bodies of state statistics, as well as state organizations subordinate to Belstat (hereinafter referred to as subordinate organizations).

The structure of the central office of Belstat comprises main departments, departments, divisions, and sections.

5. The activities of Belstat are financed from the republican budget, proceeds of activities carried out in the manner prescribed by the legislation, and other sources not prohibited by the legislation.

6. The property of Belstat is owned by the Republic of Belarus and is allocated to him on the basis of operational management.

 

Section 2

MAIN TASKS, RIGHTS, AND RESPONSIBILITIES OF BELSTAT

 

7. The main tasks of Belstat shall be as follows:

7.1. elaboration of the scientifically grounded statistical methodology and its improvement in compliance with the national and international standards in the field of statistics;

7.2. collection, processing, compilation, accumulation, storage and protection of statistical data (information) on the basis of statistical methodology;

7.3. submission of summary statistical data (information) to the President of the Republic of Belarus, National Assembly of the Republic of Belarus, Council of Ministers of the Republic of Belarus, Administration of the President of the Republic of Belarus, State Control Committee of the Republic of Belarus, republican government authorities and other state organizations subordinate to the Council of Ministers of the Republic of Belarus, to regional and Minsk-City executive committees;

7.4. dissemination of summary statistical data (information).

8. Belstat shall have the right to:

8.1. receive from government agencies and other organizations the information required to organize and conduct state statistical observations, and to compile summary statistical data (information);

8.2. receive in the manner prescribed by the legislation the information from the Unified State Register of Legal Persons and Individual Entrepreneurs, other registers (lists) and databases maintained by government agencies and other state organizations;

8.3. engage respondents, in the manner established by Belstat, into  state statistical observations;

8.4. receive from respondents on a free-of-charge basis, in the manner established by Belstat, primary statistical data in the volume and within the deadlines specified in the forms of state statistical observations;

8.5. receive in the established order from authorized state organizations maintaining state statistics, on a free-of-charge basis, summary statistical data (information) obtained from the conducted non-centralized state statistical observations;

8.6. check the integrity of primary statistical data by comparing them with the records of primary accounting documents; visit with this purpose premises and quarters (except of living quarters) of government agencies and other organizations (except of organizations enjoying diplomatic immunities under international treaties, to which the Republic of Belarus is a party), their separate subdivisions, and individual entrepreneurs;

8.7. receive the required clarifications and materials from respondents in case of any distortions detected in the data of state statistical reporting;

8.8. provide respondents with mandatory instructions to eliminate of distortions detected in the data of state statistical reporting and make corresponding changes to summary statistical data (information);

8.9. within the limits of its competence, pass normative legal acts and take mandatory for respondents decisions;

8.10. engage in the prescribed manner research and other organizations, researches and professionals to resolve selected methodological issues of state statistics;

8.11. provide clarifications, including those in the mass media, on the organization and maintenance of state statistics in the Republic of Belarus;

8.12. carry out co-operation with statistical agencies of foreign countries and international organisations in the field of statistics;

8.13. disseminate on a payment basis summary statistical data (information), unless otherwise provided for by the legislation, and provide other information services in the manner prescribed by the legislation;

8.14. compile and maintain statistical register;

8.15. in the manner prescribed by the legislation, establish, re-organize, liquidate subordinate organizations, approve their statutes;

8.16. enjoy other rights provided for by the legislation.

9. Belstat, in accordance with the assigned duties, shall be bound to:

9.1. approve forms of state statistical observations and instructions for completing thereof;

9.2. organize and carry out centralized state statistical observations;

9.3. provide respondents on a free-of-charge basis with blank forms of centralized state statistical observations and instructions for completing thereof in the quantity required for their submission to the addresses specified in these forms;

9.4. provide methodological guidance on the organisation and performance of centralized state statistical observations;

9.5. provide in the mass media required clarifications on the use of the methodology of statistical data compilation and required information on the general changes in state statistics;

9.6. provide users with summary statistical data (information) in the manner prescribed by the legislation;

9.7. exchange summary statistical data (information) with statistical agencies of foreign countries, as well as provide summary statistical data (information) under the international treaties, to which the Republic of Belarus is a party;

9.8. ensure:

accumulation, storage and protection of statistical data (information);

confidentiality of primary statistical data and usage thereof with the purpose to fulfill tasks of state statistics;

application of the uniform standards in the use of information technologies and national classifications of technical and economic, and social information usable in state statistical activity;

mobilization preparation of Belstat, as well as control over and coordination of activities related to mobilization preparation of territorial bodies of state statistics and subordinate organizations;

9.9. fulfill other duties in accordance with the legislation.

 

Section 3

MANAGERIAL BODIES OF BELSTAT

 

10. Belstat shall be headed by the Chairman who shall be appointed and relieved of office by the President of the Republic of Belarus.

11. The Chairman of Belstat shall be subordinate to the President of the Republic of Belarus and shall be a member of the Council of Ministers of the Republic of Belarus.

12. The Chairman of Belstat shall have four Deputies, including one First Deputy.

Deputy Chairmen of Belstat shall be appointed and relieved of office by the President of the Republic of Belarus upon recommendation of the Chairman.

13. The Chairman of Belstat shall:

13.1. exercise management of Belstat activities and bear personal responsibility for the fulfillment of tasks allotted to Belstat;

13.2. appoint and relieve of office Heads of territorial bodies of state statistics and subordinate organizations;

13.3. upon recommendation of the Heads of territorial bodies of state statistics and subordinate organizations, appoint and relieve of office Deputy Heads of territorial bodies of state statistics and subordinate organizations;

13.4. allocate responsibilities among Deputy Chairmen and Heads of structural subdivisions of the central office of Belstat;

13.5. prepare and submit in the manner prescribed by the legislation draft normative legal acts as well as proposals on the issues falling under the competence of Belstat to the President of the Republic of Belarus and the Council of Ministers of the Republic of Belarus;

13.6. approve the structure and the personnel list of the central office of Belstat and the number of employees of territorial bodies of state statistics to comply with the authorized total number of employees of Belstat and the salary fund thereof;

13.7. submit in the prescribed manner recommendations on awarding of state honours to the employees of the central office of Belstat, territorial bodies of state statistics and subordinate organizations, apply other incentive measures therefor;

13.8. exercise other powers in accordance with the legislation.

14. A Collegium shall be set up in the Belstat, that shall be composed of the Chairman (Chair of the Collegium), Deputy Chairmen, Heads of the structural subdivisions of the central office of Belstat, as well as the Heads of the territorial bodies of state statistics and subordinate organisations.

The number of members and the membership of the Collegium shall be approved by the President of the Republic of Belarus upon recommendation of the Chairman of Belstat.

Decisions of the Collegium shall be documented in the records.
